Washington joins the ERP movement: what producers need to know
On May 17, Washington State became the 7th U.S. state to pass extended producer responsibility (EPR) legislation for packaging. Governor Bob Ferguson signed SB 5284 law(Recycling Reform Act), marking a major turning point in the reform of the recycling system. From now on, the entire West Coast of the United States – California, Oregon and Washington – is covered by an EPR program for packaging.
Key dates and obligations to remember
Here are the essential milestones and deadlines for producers subject to the regulations:
- January1st, 2026: a management body (OGD) must be appointed by the State.
- July 1st, 2026: deadline for producers to join the OGD.
- September 1st, 2026: payment of the first annual registration fee to the State.
- October 1st, 2026: publication by OGD of a statewide collection list, specifying the covered materials to be declared.
- December 31st, 2026: submission of the first needs assessment, which will be used to set program performance targets.
- January 1st, 2030: official start of the program – producers will have to comply fully from this date onwards.
